The Individuals with Disabilities Education Act of 2004 (IDEA) imposes new requirements on states and school districts. New York State Education Law, as amended by Chapter 352 of the Laws of 2005, effective July 1, 2005 includes conforming changes to IDEA 2004. At its December 2005 meeting, the Board of Regents adopted amendments to Regulations of the Commissioner of Education to conform these rules to the IDEA and to Chapter 352, effective December 29, 2005.

This bulletin summarizes the key amendments to New York State Education Law and Parts 200 and 201 of the Regulations. Please note: Further changes to NYS Education Law and Commissioner's Regulations may be necessary after the final federal regulations are adopted. It is anticipated that these regulations will be finalized prior to the start of the 2006-2007 school year.
