No Child Left Behind: final 2004-05 consolidated application update and Title I application supplement

no child left behindThe final 2004-05 Consolidated Application Update and Title I Application Supplement for the No Child Left Behind Act and other associated documents are now available.

The No Child Left Behind Act (NCLB) includes the most significant changes in federally funded program expectations and requirements since the original Elementary and Secondary Education Act (ESEA). Changes in State and local accountability, public school choice, supplemental educational services, "highly qualified" staff, unsafe school choice, and parents' "right to know" are some of the important provisions contained in the Act.

An update on NCLB and the requirements for the Consolidated Application Update and Title I Application Supplement will be presented to upstate Local Educational Agencies (LEAs) and Charter School LEAs at meetings conducted in Albany (Chancellor's Hall), Rochester (St. John Fisher College) and Long Island (State University of New York at Stony Brook) in May 2004.  Additional NCLB information is also available on the United States Department of Education NCLB website, http://www.ed.gov/nclb/.

The Consolidated Application Update process is designed to reflect requirements identified in NCLB that will assist LEAs/Charter School LEAs to implement programs to meet the instructional needs of all students. Please note the following when completing the 2004-05 Consolidated Application Update and Title I Application Supplement:

  • The Title III, Part A Language Instruction for Limited English Proficient and Immigrant Students program is included under the Consolidated Application for the first time. Please be aware this is an update year for Title III, Part A as well, unless your LEA is applying for the first time for Title III funds. The Part 154 Application for State funds will be included under a separate application. The Title III, Part A: Language Instruction for Limited English Proficient and Immigrant Students School Year 2004-2005 Biennial Evaluation Report will be submitted through a separate process to the State Education Department and not as part of the Consolidated Application Update. Information regarding the completion and submission of the biennial report will be forthcoming from the Office of Bilingual Education.
  • The "Updated Fact Sheet with Highlights of the NCLB Requirements for Teachers and Paraprofessionals in New York State" Field Memo #02-2004 is part of the Consolidated Application Update package. This information is relevant to completing the Consolidated Application Update.
  • A Consultation/Collaboration Form is again included in the Consolidated Application Update on page 19. This form documents required consultation/collaboration in the development of the Consolidated Application Update and Title I Application Supplement. Guidance is also part of the Consolidated Application Update package.
  • The 2004-05 Title I Application Supplement will be available for on-line submission for the first time. It can be accessed from the same page as the full Consolidated Application Update. Please note that the on-line version of the Supplement will be the only method for submission. The Title I Application Supplement must be received by SED no later than July 15, 2004. A confirmation e-mail message will be sent from SED which will list all data submitted. Any errors will be resolved via e-mail.
  • The Funded Administrative Position Description Form that was formerly included as part of the Title I Supplement will now be included as part of the Consolidated Application Update on page 68.
  • A Budget Narrative must be submitted with the FS-10 for each Title in this Consolidated Application Update to provide an explanation of expenditures as they relate to each program narrative.
  • As part of the development of the 2004-05 Consolidated Application Update, the LEA must engage private school administrators in all private schools within the geographic boundaries of the LEA in timely and meaningful consultation regarding the provision of educational services and other benefits that address the needs of eligible children. (See page 62 of the Consolidated Application Update for the "Private School Participation Form" required for each private school in the LEA.) Only Charter School LEAs are exempt from the requirement to consult with private school officials.
  • For additional information on the Safe and Drug-Free Schools Program alignment to the Principles of Effectiveness please refer to the Department's Student Support Services website, http://www.emsc.nysed.gov/rscs/chaps/chapshome.htm.

The 2004-05 Consolidated Application Update for the No Child Left Behind Act includes the following funded programs:

  • Title I Part A, Basic Program and Title I Part D Neglected, Delinquent or At-Risk
  • Title II Part A, Teacher and Principal Training and Recruiting
  • Title II Part D, Enhancing Education Through Technology (Formula Funds Only)
  • Title III Part A, Language Instruction for Limited English Proficient and Immigrant Students
  • Title IV Part A, Safe and Drug Free Schools and Communities
  • Title V Part A, Innovative Programs
  • Title VI Part B, Subpart 2 Rural Education Initiative, Rural and Low Income School Program

All LEAs/Charter School LEAs are required to submit a 2004-05 Consolidated Application Update along with an FS-10 for each program for which funds are requested. For new Charter School LEAs applying for the first time, a complete Consolidated Application, including all sections, must be submitted. LEA/Charter School LEA preliminary allocations for 2004-05 will be added to the Consolidated Application Update package on the website when available. It is anticipated that final LEA/Charter School LEA allocations for 2004-05 will be available in January 2005 on the website.

Please note that under federal regulation (EDGAR 34 CFR Section 76.708(a)), LEAs/ Charter School LEAs may not obligate funds distributed by formula under any of the above Titles until the 2004-05 Consolidated Application Update is submitted in substantially approvable form as determined by the State Education Department. LEAs/Charter School LEAs are encouraged to submit their Consolidated Application Update in advance of the August 31, 2004 deadline.

Additional information for LEAs/Charter School LEAs as they prepare their budgets can be found at the Department Grants Finance Office website, http://www.nysed.gov/cafe/, including "Frequently Asked Questions" relating to the FS10, FS10-A and FS10-F fiscal forms. For 2004-05 all LEAs/Charter School LEAs should complete project code numbers on the FS-10s as last year. The only change will be the project year which will be 05 instead of 04. Please refer to the Consolidated Application FS-10s for 2003-04 for the codes for each Title. The only exception will be new Charter School LEAs opening in September 2004. They should call the Title I School and Community Services Office to get the 2004-05 project code numbers assigned.

Please note that for the 2004-05 school year, LEAs with Schools in Need of Improvement (SINI), Schools in Corrective Action (SCA), or Restructuring will apply for additional Title I Improvement Funds through a separate application and FS-10 to be available at a later date.
