The following report from Patrick Lyons - - NYSUT Legislation:
NYSUT's Health Insurance Moratorium Extender (Eff. to 5/15/09)
has been signed into law by Governor Paterson
(Chapter 43 of the Laws of 2008) (See Also, S.6650 by Sen.
Farley/A.9942 by Asm. Weinstein).  The Health Insurance
Moratorium Extender has been signed into law by the Governor
. . . so, we're good for another year ('til 5/15/09).
Keep in mind that this law only protects what has been
(and continues to be) successfully negotiated at the local level.

MEDICARE PART D PRESCRIPTION NOTIFICATION

Now that we are in the second year of the Medicare Part D prescription program questions have arisen about the employer responsibility to notify Medicare participants of their status.  The law requires a yearly notification as to the status of your prescription benefit through your employer provided plan.  The employer is required to inform you if you have comparable coverage which means your employer coverage is equal to or better than the federal Medicare Part D benefit.  If your coverage is equal to or better than the Medicare Part D coverage you need do nothing but save the notice.  Questions had risen about how often the employer must inform you as to your status.  The regulation requires notification by the employer once a year.
